End User License Agreement (Terms of Service)

1. Agreement to Terms

By downloading, installing, or using The Beat mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

The Beat provides automated monitoring of Musician's Friend "Stupid Deal of the Day" promotions and compares pricing against Reverb.com marketplace listings. The App rates deals and provides push notifications for deals meeting certain criteria.

3. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You may not:

• Modify, reverse engineer, or decompile the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or services
• Use automated scripts or bots to access the App

4. Affiliate Disclosure

The Beat participates in affiliate programs with Musician's Friend and Reverb.com. When you click links to these retailers and make purchases, we may earn a commission at no additional cost to you. This does not influence our deal ratings or analysis, which are automated and objective.

5. Accuracy of Information

While we strive for accuracy, we do not guarantee that:

• Product information, pricing, or availability is current or error-free
• Deal ratings reflect actual market conditions at all times
• Products will be available at advertised prices when you attempt to purchase

All pricing and product information should be verified on the retailer's website before purchase.

6. No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Third-Party Services

The App relies on third-party services including:

• Firebase (Google) for data storage and push notifications
• Musician's Friend for product information
• Reverb.com for market pricing data

We are not responsible for the availability, accuracy, or performance of these third-party services.

9. Modifications to Service

We reserve the right to modify or discontinue the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

10. Updates and Changes

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will notify users of material changes through the App or via email if provided.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
